1. Acceptance of Terms

By accessing or using the Elygius Fund website, application, and smart contracts (collectively, the “Platform”), you agree to be bound by these Terms & Conditions. If you do not agree with any part of these terms, you must not access or use the Platform.

2. Description of Services

Elygius Fund provides decentralized crypto asset protection services. Our Platform enables users to insure their digital assets against risks including, but not limited to: smart contract exploits and hacks, private key loss or compromise, unauthorized access to wallets or accounts, and phishing attacks targeting crypto holders.

Insurance is facilitated through on-chain smart contracts and a backend relayer system. Users interact with the Platform by connecting an Ethereum-compatible wallet, selecting assets to insure, and executing the appropriate transaction flow (direct transfer, EIP-2612 permit signature, or token approval).

3. Eligibility

You must be at least 18 years old and legally capable of entering into binding agreements in your jurisdiction. By using the Platform, you represent that you meet these requirements and that your use complies with all applicable laws and regulations in your jurisdiction.

4. Wallet Connection & Security

Access to the Platform requires connecting a compatible Ethereum wallet. You are solely responsible for the security of your wallet, including safeguarding private keys, seed phrases, and any credentials used to access your wallet. Elygius Fund does not have access to your private keys and cannot recover lost or compromised wallets.

5. Smart Contract Interaction

By using the Platform, you acknowledge that you interact directly with smart contracts deployed on the Ethereum blockchain. These interactions are irreversible once confirmed on-chain. Elygius Fund is not party to the smart contracts in the sense of traditional contractual relationships — the contracts execute autonomously according to their coded logic.

You acknowledge that smart contracts, while audited, may contain vulnerabilities and that blockchain transactions carry inherent risks including but not limited to network congestion, gas price fluctuations, and potential protocol-level issues.

6. Fees & Transactions

Certain transactions require payment of Ethereum network gas fees. For gasless deposit flows (e.g., USDC via EIP-2612 permit), our relayer covers gas costs on your behalf. Elygius Fund reserves the right to modify fee structures with reasonable notice to users.

7. Limitation of Liability

The Platform is provided “as is” and “as available” without warranties of any kind, express or implied. Elygius Fund shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or digital assets, arising from your use of the Platform.

You expressly waive and release Elygius Fund from any and all liability, claims, causes of action, or damages arising from or related to your use of the Platform or smart contracts.

8. Intellectual Property

All content on the Platform, including but not limited to text, graphics, logos, icons, code, and software, is the property of Elygius Fund and is protected by applicable copyright and intellectual property laws. Any duplication or distribution of content in part or in entirety, in changed or unchanged form, requires written consent.

9. Third-Party Links

The Platform may contain links to third-party websites and services. Elygius Fund does not have control over the content of these external sites and assumes no responsibility for their content, privacy policies, or practices.

10. Modifications

We reserve the right to modify these Terms at any time. Material changes will be communicated to users via email or in-platform notice. Your continued use of the Platform after changes have been posted constitutes acceptance of the revised terms.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United Kingdom, without regard to conflict of law provisions.
